§ 113.04. BUILDING PERMITS; DENIAL OF PERMIT.

- (A) No person shall construct, expand, remodel or make alterations to the sanitary facilities in a mobile home park within the city without first obtaining a permit therefor from the Board, except that no permit shall be required in the making of minor repairs or in matters of general maintenance. The application for the permit shall be made to the Board in the manner as may be prescribed by regulations of the Board, which shall require the applicant to supply plans and specifications and otherwise provide a description of the nature, type, location and extent of the sanitary facilities contemplated. When the application has been approved, the Board shall issue a permit to the applicant to construct, expand, remodel, or make alterations to sanitary facilities, including water and sewage disposal, upon a mobile home park and the appurtenances thereto according to the plans and specifications and other data submitted with the approved application. No approval of plans and specifications and issuance of a permit to construct, expand, remodel, or make alterations upon a mobile home park and the appurtenances thereto by the Board shall be made unless the park is in compliance with the provisions of this chapter governing mobile home parks and the rules, regulations, and standards of the Board. A permit does not relieve the applicant from obtaining building permits when located within the city or from complying with any other city resolution, ordinance, or regulation applicable thereto, and not in conflict with the provisions of this chapter governing mobile home parks.(Prior Code, § 10-405)(B) (1) If the application for a permit to construct, expand, remodel, or make alterations upon a mobile home park and the appurtenances thereto, pursuant to division (A) of this section, is denied by the Board, it shall so state in writing, giving the reasons for denying the application. If the objection can be corrected, the applicant may amend his or her application and resubmit it for approval. No permit shall be denied except after due notice and opportunity for a hearing before the Board.(2) When the Board has approved an application for a permit to construct, expand, remodel, or make alterations upon a mobile home park or appurtenances thereto, pursuant to this chapter, or a license to establish, conduct, operate, or maintain a mobile home park, it shall retain the original and keep a file thereof. One copy shall be returned to the applicant or his or her agent.(3) The Board shall furnish all necessary forms to be completed in making application for all licenses or permits issued pursuant to the provisions of this chapter governing mobile home parks.(Prior Code, § 10-406)
